MEMBERSHIP TERMS AND CONDITIONS Terms and Conditions Agreement - Sorry Not Public (SNP) Private Members Club
THIS IS AN IMPORTANT DOCUMENT – PLEASE ENSURE THAT YOU READ IT CAREFULLY
Effective Date: As soon as membership is approved through the application process.
1. Our Agreement:
This agreement is made between Sorry Not Public LLC ("Us," "We," "Our," or "Sorry Not Public") and the member whose name appears in the application for membership agreement ("you").
The Rules, these Terms and Conditions, Health Check Questionnaire, and your Membership Application Form collectively constitute the entire agreement between the parties ("the Agreement"). Any previous representations or documents, whether provided by Sorry Not Public or its agents or employees, are excluded from this Agreement.
It is your responsibility to carefully read, understand, and comply with all the terms and conditions of the Agreement. If you have any questions, please do not hesitate to ask us.
"Rules" refers to the binding rules that apply to all members, visitors, and guests. These rules are communicated to you through signage, handouts, or our website (www.SorryNotPublic.com).
2. Membership Types and Fees:
a. Sorry Not Public Membership (12 month commitment): $35 per month with a 12-month commitment, $50 annual fee, $150 cancelation fee
b. Sorry Not Public Membership (0 commitment): $87 per month with no commitment and no cancellation fee.
c. Sorry Not Public Membership (Team commitment): $100 per month with a 12 month commitment, $100 annual fee, $250 cancelation fee
d. Sorry Not Public Membership (Team 0 Commitment): $135 per month with no commitment and no cancelation fee.
3. Annual Fee:
a. An annual fees will be applied 90 days after approval of the membership application.
b. This fee is essential for maintaining our high standards by covering equipment upkeep, facility maintenance, and periodic upgrades at our locations, ensuring you have access to top-quality services.
4. Cancellation:
a. Cancellation Fee: $150/$250 for the 12 month commitment Membership. This fee helps us manage the costs associated with early termination, including administrative processing and the impact on our community resources.
b. Members must return their key fob upon cancellation. Failure to do so will result in a $20 charge.
c. Cancellations must be processed in person by visiting the club, where you will be required to sign the cancellation form and confirm the termination of your membership.
d. Members must provide a reason for cancellation to help us improve our services.
5. Membership Application:
a. Members must fill out the membership sign-up fields accurately and honestly. Providing false information or misleading details may result in immediate termination of membership.
b. There is a non-refundable membership application fee of $35, which covers the administrative costs associated with processing your application.
6. Age Restriction:
a. All individuals entering our locations must be at least 21 years of age.
7. Guests:
a. Members can bring up to two guests.
b. Guests must be accompanied by the member throughout their visit. If not accompanied, guests must leave the premises.
c. Guests must obey the same rules and regulations as members. Failure to do so may result in the guest being asked to leave the premises.
8. Gym Usage:
a. Members are responsible for maintaining cleanliness in the gym area. This includes wiping down equipment, returning weights to their designated areas, and disposing of any trash appropriately.
9. Gym Liability:
a. Sorry Not Public (SNP) Private Members Club is not liable for any injuries or death that may occur while using the gym facilities. Members use the gym at their own risk.
10. Member Conduct:
a. Members must respect other members, employees, and guests of Sorry Not Public.
b. Members are required to obey all club rules and regulations.
c. SNP Membership members are encouraged to actively contribute to the growth and enhancement of our club and community by bringing value through their actions, ideas, and participation.
d. Members who cause any damages to the facilities or property of Sorry Not Public will be subject to fines and may face termination of their membership.
e. In cases where damages are severe or repeated, Sorry Not Public reserves the right to terminate the membership and trespass the member from all locations.
11. Termination:
a. Sorry Not Public (SNP) Private Members Club reserves the right to terminate a member's membership without their consent if they violate any rules or regulations of the club.
12. Bartender Discretion:
a. Bartenders may refuse service to any member who they believe has consumed excessive amounts of alcohol.
b. Sorry Not Public (SNP) and its bartenders are not liable for any incidents that occur after members leave the establishment.
c. Members and their guests are not allowed to engage in binge drinking and must drink responsibly.
13. Security:
a. Sorry Not Public (SNP) Private Members Club security personnel have the right to remove any member or guest who fails to comply with the club rules and regulations.
14. Fee Changes:
a. Sorry Not Public (SNP) Private Members Club reserves the right to change the membership fees and introduce commitment or initiation fees in the future.
b. Current members will be grandfathered in at their current membership price and will not be subject to any new commitment or initiation fees.
15. Dress Code:
a. Members must adhere to the dress code at Sorry Not Public (SNP) Private Members Club.
b. During the day, members must dress in business casual attire, business professional, or fashionable.
c. Sorry Not Public (SNP) reserves the right to deny entry to individuals who do not meet our dress code standards.
d. Members must also adhere to the dress code and security requirements at specific events held at the club. Failure to comply may result in denial of entry by security, employees, or staff.
16. Club Etiquette:
a. Members must always speak highly of Sorry Not Public (SNP) Private Members Club.
b. Members must not disclose or share information about other members or their activities within the club to anyone outside the club.
c. Members must respect the privacy of other members and maintain confidentiality.
17. Personal Trainers:
a. Personal trainers employed or contracted by Sorry Not Public must respect the privacy and boundaries of members.
b. Personal trainers are not allowed to ask for personal member information without the explicit authorization of the member.
c. Sorry Not Public is not liable for any injuries or death that may occur during personal training sessions. Members engage in personal training at their own risk.
d. Personal trainers must provide proof of certification and maintain current certification throughout their employment or contract period.
e. Members have the opportunity to become personal trainers at Sorry Not Public, subject to meeting the necessary qualifications and obtaining appropriate certification.
f. Personal trainers must actively bring value to Sorry Not Public by attracting and retaining valuable members to our community.
18. Future Locations:
a. Sorry Not Public may open additional locations in the future.
b. Each future location may have its own specific terms and conditions that members must adhere to.
c. Members are responsible for reading and understanding the terms and conditions of each location before checking off and agreeing to them.
d. Depending on the location, members may have access with their current membership, while in some locations, an upgrade to their membership may be required to gain access.
19. Membership Tiers:
a. Sorry Not Public may introduce different tiers of memberships in the future.
b. Each membership tier may have its own specific benefits, privileges, and fees.
c. Members will have the option to upgrade or downgrade their membership to a different tier, subject to the terms and conditions associated with each tier.
d. Sorry Not Public will communicate any changes to the membership tiers and associated fees in a timely manner to all members.
20. Collection of Fees:
a. If a membership is terminated for any reason outlined in this agreement, Sorry Not Public reserves the right to recover any outstanding membership dues and fees.
b. In the event of a breach of this agreement, including termination of membership, Sorry Not Public may incur reasonable costs and expenses to recover the outstanding amounts.
c. These costs and expenses may include, but are not limited to, engaging an external collection agency and legal costs.
d. Sorry Not Public reserves the right to pursue all available legal remedies to recover the outstanding amounts, without limiting any other rights or remedies.
21. Interruption of Services:
a. Sorry Not Public may need to restrict the use, temporarily close, or halt Sorry Not Public activities from time to time due to repair, maintenance, public holidays, or special occasions.
b. During such periods, there will be no reduction, suspension, abatement
